1. GENERAL CONDITIONSThe general conditions of sale, listed below, are valid for any order placed with Amati S.p.a. and they are essential part of each order.Any changes to these terms and any special conditions must be expressly agreed in writing.By placing an order, the Customer declares to have read all the informations provided to him during the purchase process, and to accept the general conditions below.
The customer is not entitled to damages or compensation, and any contract or tort liability for direct or indirect damages to persons and / or property, caused by lack of acceptance, even partial, of an order.
Orders are carried out directly on the site, and the transaction is done on a secure server ssl.
If the order is correct it will be confirmed by an e-mail, sent to the email address supplied by the customer.
The goods travel at your risk and the customers, in their own interest, must check the integrity of packages and quantity of the goods received before signing the delivery receipt.
All claims must be filed directly with the carrier at the time of delivery.
It’s possible to buy shipping insurance to cover partial theft and loss by the carrier during the purchase process.
The goods are delivered ex our shop in Turin.
The terms of delivery are purely indicative and not contractual.
For items out of stock, please contact our Sales Office.
All prices quoted are VAT excluded for clients from Italy and European Countries, while are VAT excluded for the rest of the world.
Amati S.p.a. reserves the final right to make changes to the published prices in case it becomes necessary.
The prices of the items sold online may differ from the prices of the same items in the store, we recommend that you purchase through the website.
6. RIGHT OF WITHDRAWAL
Pursuant to art. 5 DL 185/1999, if the customer is a consumer (a person who buys goods for purposes not related to his professional activity, or does not indicate the purchase order form a reference to VAT), he is entitled to rescind the purchase contract for any reason, without explanation and without penalty, except as described in the following paragraphes.
Such notice shall be sent by registered letter with acknowledgment of receipt, addressed to: Amati S.p.a. Via Bari 2 00161 Turin, or by telegram or fax sent within the period of 14 days and followed by a confirmation by registered letter with acknowledgment of receipt, must be sent within 48 hours.
Once you have received the notice of termination, we’ll give the customer instructions on how to return the goods which must be received Amati S.p.a. within 14 days from authorization.
The right of withdrawal is subject to the following conditions:
- The right applies to product purchased in its entirety, it can be exercised only on part of a product (eg accessories, attachments, etc. …);

- Amati S.p.a. is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments;
- On his arrival in stock, the product will be inspected for any damages not caused by transport.
The right of withdrawal is lost for lack of the essential integrity of the property (the packaging and / or its contents), in cases where Amati S.p.a. finds:
- The lack of external and / or internal packaging;
- The lack of integral elements of the product (accessories, cables, manuals, parts, …);
- The product is damaged for causes other than its transport.
- The lack of tax records/invoice.
In case there’s no right of withdrawal, Amati S.p.a. will return to customer the property purchased by charging the same shipping costs.
Without prejudice to the above points Amati S.p.a. will transfer the total amount to the customer by bank transfer.
In this case, the buyer shall promptly provide the bank on which to obtain a refund (ABI – CAB – SWIFT CODE – Account of the invoice and so on).
7. RETURNS AND CLAIMS
Any disputes must be sent in writing to Amati S.p.a..
The return of merchandise must be authorized in advance by email.
Authorized returns must be sent to the warehouses of Amati S.p.a., accompanied by original packaging including instructions and receipt or tax document.
Once we have verified the fault, if attributable to the product, the goods will be replaced.
At the sole discretion of Amati S.p.a. in case of unavailability, the goods will be replaced with other goods of equal or higher value or credited back the purchase price of the goods.
If the failure was due to the buyer for misuse of the product or tampering and wear, the product will be returned to the purchaser who will pay the shipping costs.
All shipping charges for returns and shipments are buyer’s responsibility.

9. PROPERTIES OF GOODS
Amati S.p.a. retain ownership of the goods until full payment by the customer.
Amati S.p.a. can not be held responsible for any inaccuracy found in the technical characteristics of the data or information relating to the products in the website www.amatimodel.com and therefore does not assume any responsibility for any damage caused or received in the use of the products.
Every picture, document, software, tab, in the website can be edited or removed at any time without communications and without notice.
All products sold by Amati S.p.a. are covered by the manufacturer’s standard warranty, 24 months warranty for defects of conformity, in accordance with law 24/02.
To qualify for the warranty, the customer must keep the invoice / receipt.
The manufacturer’s standard warranty is provided in the manner described in the documentation included in the packaging of the product.
If, as a result of check by an authorized service center, the defect is not covered by the manufacturer’s standard warranty, the customer will be charged for any costs of verification and restoration required by the service center, and the transportation costs, if supported by Amati S.p.a.
The guarantee of 24 months in accordance with law 24/02 applies to products that present a conformity defect, provided the product is used correctly, in accordance with its intended use and as provided in the technical documentation.
This guarantee is for private consumption (a person who buys goods for purposes not related to his professional activity, or making a purchase without indicating in the order form a reference to VAT).
In case of lack of conformity, Amati S.p.a., at no cost to the customer except shipping cost, will repair / replace or reduce the price, until the termination of the contract.
If, as a result of intervention by an authorized service center, the defect does not result in a lack of compliance with the law 24/02, the customer will be charged for any costs of verification and restoration required by service center, and the shipping costs.
In the event that, for whatever reason, was not able to make its customers a product warranty (repaired or replaced), Amati S.p.a. will proceed at its own discretion to refund the amount paid for the product or its replacement with a similar or better product.
No damage can be obtained from Amati S.p.a. for any delays in repairs or replacements.
In cases of return of the product, the product must be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessories), to limit damage to the original package, we recommend, when possible, to put it in another box should be avoided in all cases the attachment of labels or tape directly on the original product packaging.
For any controversy refers to the Court of Turin.
